March 15, 2013 Commission Position on LBMA (PDF, 141KB) The Commission for Independent Education has received information indicating the position of the United States Department of Education (US DOE) on Florida's licensure requirements as they relate to federal State Authorization regulations.

It is the Commission's position that institutions licensed by means of accreditation (LBMA) in Florida are not exempt from approval or the licensure requirements of the Commission based upon accreditation or any other exemption. Therefore, LBMA is a license and not an exemption.

Page one is the Commission's letter to US DOE regarding the Commission's position. Pages two to four (also sent to US DOE) contain the official response from CIE legal counsel.
March 21, 2011 States that Comply with New Federal Regulations (PDF) Kessenick, Gamma & Free, L.L.P., evaluated the 50 states’ legislative schemes to determine which ones would currently meet the new federal regulations, CFR 34 §600.9(c) (Federal Register, page 66946). The memo provides that, after a cursory review of states’ legislative schemes, only 12 of the states will comply with the new federal regulations. Florida is listed as one of those 12 states. The reference to Florida is contained on page four.
